General terms and conditions

The business relationship between Bix’n Andy and the customer is governed exclusively by these general terms and conditions. Bix’n Andy does not accept any terms and conditions that conflict with or deviate from these GTC and hereby expressly denies them. Conflicting terms and conditions of the customer are only valid if Bix’n Andy expressly agrees to them in writing.

Time of conclusion of the contract
By clicking on the “Send order” button, you place a binding order for the goods contained in the shopping cart. Order confirmation follows immediately after sending the order. The purchase contract is concluded with our delivery confirmation and / or delivery of the goods.

Delivery times
Please refer to the product description for the estimated delivery time. If no details are given, delivery is usually concluded within 3 days after receipt of payment if your order is accepted. An agreement concerning longer delivery times at your request is possible.

Partial deliveries
We are entitled to make partial deliveries. Additional shipping costs will only occur if agreed by both parties.

Cancellation policy

A. Cancellation policy for consumers
By initiating the order process, the buyer, who is to be regarded as a consumer and who is not placing the order as part of a business, consents to receiving the information on the right of withdrawal in accordance with Section 5 (1) of the German Civil Code (BGB). 1 FAGG and the information specified in Section 4 1 FAGG in the course of confirming his order by email.

You can cancel your contractual declaration within 2 weeks without giving reasons in text form or by returning the goods. The period begins at the earliest with receipt of the valid terms and conditions. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter, fax or e-mail sent by post) within 2 weeks of order confirmation.

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the end of the cancellation period.

Consequences of revocation
In the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g. interest) surrendered. Special information
Your right of withdrawal expires prematurely if your contractual partner has started to perform the service with your express consent before the end of the withdrawal period or if you have initiated this yourself (e.g. by downloading, etc.).

Warranty
The warranty is provided in accordance with the statutory provisions, whereby in the event of a defect in the goods we will, at your discretion, first deliver or repair the goods. If the rectification of the damage fails or if the subsequently delivered goods are also defective, you may return your goods for a full refund of the original purchase price or keep the goods and reduce the purchase price. Please refer to the product documentation for information on any manufacturer warranties.
Liability is limited to the item price, except in cases of intent.

Retention of title
The delivered goods remain our property until full payment has been made.

Place of jurisdiction
Austrian law shall apply to the exclusion of conflict of law rules (IPRG and EVÜ) and to the exclusion of the United Nations Vienna Convention on Contracts for the International Sale of Goods (CISG; BGBl 1988/96).

The contracting parties agree that the district court of Kufstein shall have jurisdiction for all disputes, irrespective of the amount in dispute.

Reduction of validity
If provisions of these General Terms and Conditions, the Supplementary General Terms and Conditions and any other agreements are or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision which comes as close as legally possible to the originally intended purpose. The same applies to the filling of a contractual gap.

Privacy policy
We use your inventory data exclusively to process your order. All customer data is stored and processed by us in compliance with the relevant provisions of the Federal Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG).

You entitled to information regarding, correction of, blocking and deletion of your stored data at any time. Please contact andy@bixn-andy.at or send us your request by post or fax.

We do not pass on your personal data to third parties, including your home address or e-mail address, without your express consent, which can be revoked at any time. Excluded from this are our service partners who require the transmission of data for order processing (e.g. the shipping company commissioned with delivery and the credit institution commissioned with payment processing). In these cases, however, the scope of the transmitted data is limited to the necessary minimum.

All prices mentioned are final prices including VAT and monopoly tax (except in our wholesale). Despite everything we try to look after your goods and offered services, we sometimes make mistakes. Therefore, we reserve the right to deliver your order in the event of errors, unjustifiable price and product changes, as well as delivery bottlenecks on the part of our upstream suppliers.
